By downloading, installing, or using Darwin ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
Darwin is a task prioritization application that uses a ranking algorithm to help you determine the relative importance of your tasks. The App is provided by Phoenix Strategies LLC ("we", "us", "our").
To use the App, you must create an account using Google Sign-In, Apple Sign-In, or a passwordless email link. You are responsible for maintaining the security of your account and for all activities that occur under your account.
You retain ownership of all tasks, goals, and other content you create within the App ("User Content"). By using the App, you grant us a limited license to store and process your User Content solely for the purpose of providing the service to you.
You are solely responsible for your User Content. We do not monitor, review, or endorse User Content.

The App, including its design, code, animations, and branding, is the property of Phoenix Strategies LLC and is protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App.
Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.
We strive to keep the App available at all times, but we do not guarantee uninterrupted access. We may modify, suspend, or discontinue the App at any time without prior notice. We are not liable for any downtime or service interruptions.
The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by law, Phoenix Strategies LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or in connection with your use of the App.
We may update these Terms from time to time. Changes will be posted on this page with an updated revision date. Continued use of the App after changes constitutes acceptance of the updated Terms.
We reserve the right to suspend or terminate your access to the App at any time, for any reason, without prior notice. Upon termination, your right to use the App ceases immediately.
These Terms are governed by the laws of the State of Rhode Island, without regard to its conflict of law principles.
